Information regarding the processing of personal data for the sending of the Newsletter, pursuant to Article 13 of the EU Regulation 2016/679
Newsletters and / or commercial offers and / or communications relative to initiatives such as fairs, events and / or promotion of new products of D.M.C. S.r.l. (hereinafter “Controller”) are accessible electronically from the address www.bijouets.com, corresponding to the initial page of the Site (hereinafter “Site”) and distributed via e-mail – automatically and free-of-charge – to anyone making the request by entering their personal data (hereinafter “Data”) in the form located on the page and in any case to anyone who has expressed their consent to it being sent (hereinafter “Interested Party”). The communication of the Data is optional and the failure to provide it by the Interested Party will only entail the Controller’s inability to send the Newsletter and therefore to provide the service.
The data provided will be used with the sole purpose of providing via email the service requested and, for that reason, will be kept exclusively for the period when it will be active. The legal basis of the processing is the consent of the interested party, in addition to the legitimate interest of the Controller to provide information useful for the company business and information relative to the services offered as part of its business. The Data will be processed exclusively by the personnel and associates of the Controller (“Authorized Individuals”) of by third parties who, each time, depending on the cases, will process the Data as independent data controllers and / or as outside processing managers specifically appointed by the Controller (e.g. outside suppliers who manage technological maintenance services of the site) – a list of these possible outside subjects is available at the interested party’s request -. The Data will not be disseminated. The logics of the processing will be focused on making sure that the Data is processed securely, is always intact and available and is processed in compliance with the principles provided in the EU Regulation.
Furthermore, the interested party has the right to exercise the following rights (specifically described in Art. 15 to Art. 22 of the EU Regulation), by contacting without any particular formalities the Data Controller (at the e-mail address listed below): ask the Data Controller to confirm that the personal data that concerns them is being processed or not and, in that case, obtain access to the Data; request its correction and / or supplement, cancellation or limitation of its processing; object to the processing; request its portability; revoke the consent if the processing is based on the consent provided previously without prejudicing the legality of the processing given before the revocation; file a complaint with a control authority; obtain all the information available on the origin of the Data and on the categories of Data, if it was not collected from the Interested Party; obtain information on the existence of an automated decision-making process, including profiling and, at least in those cases, significant information on the logic used, as well as the importance and consequences anticipated of that processing to the Interested Party; not be subject to a decision based solely on the automated processing, including profiling.
The Data may be transferred to countries outside the EU only in compliance with the Regulation and therefore based on a decision of the European Commission of adequacy of the level of protection of the personal data guaranteed by the third party country or on the basis of adequate guarantees, or, failing that, should it be necessary for the implementation of a contract between the Controller and the Interested Party or for the implementation of pre-contractual measures adopted at the request of the Interested Party, or on the basis of the prior consent of the Interested Party (for purposes other than the aforementioned). For the consent to be valid, the Interested Party is informed in advance that, without that decision and / or adequate guarantees, the transfer could entail the risk of destruction, loss, modification, accidental or illegal access, unauthorized disclosure of the Data sent, stored or in any case processed with computer means or not. In particular, the Data can be transferred to countries outside the EU, as part of the aforementioned purposes if, in order to manage the outside services that the Controller uses (as is the case of the management service of the website or the electronic mail), the third party supplies of those services – as outside managers or autonomous controllers – use servers that are located in third party countries; the Controller uses Mailchimp (the servers of which are located in the United States) for sending commercial communications and in that case the transfer is made with a decision of adequacy (Privacy Shield); in any case the transfers outside the EU will take place with a decision of adequacy or adequate guarantees, or failing that, based on the consent of the Interested Party.
